These Terms of Use (the “Terms”) are a binding agreement between you and FilmShuffle LLC, an Indiana limited liability company (“FilmShuffle,” “we,” “us,” or “our”). These Terms govern your access to and use of filmshuffle.app, FilmShuffle web applications, and any related pages, features, tools, content, communications, and services that link to these Terms (collectively, the “Service”).
Please read these Terms carefully. By creating an account, clicking to accept these Terms, submitting content, purchasing a paid service, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy, Community Guidelines, Copyright and DMCA Policy, and Intimate Image Removal Policy are incorporated into these Terms by reference. Additional terms presented for a specific feature, promotion, or purchase also apply to that feature, promotion, or purchase. If additional terms conflict with these Terms, the additional terms control only for the feature, promotion, or purchase they address.
1. Who may use FilmShuffle
1.1 Minimum age
You must be at least 16 years old to create an account or use signed-in or community features. By creating an account, you confirm that you are at least 16.
People under 16 may browse public pages and use any guest ranking demonstration that FilmShuffle makes available without an account, but they may not create an account, publish content, participate in community features, or transfer guest-demo activity into an account.
1.2 Users under 18
If you are under 18, you represent that your parent or legal guardian has reviewed and authorized your use of the Service. You may purchase a paid service only with the authorization of a parent or legal guardian who has legal authority to approve the purchase and recurring charges.
1.3 Authority to act for an organization
If you use the Service for a company, organization, Club, or other entity, you represent that you have authority to bind that entity to these Terms. In that situation, “you” includes both you and the entity.
2. The Service and beta status
FilmShuffle helps people discover, rate, rank, log, discuss, organize, and share films and related interests. Features may include profiles, film ratings, My Favorite Films, 100 Highest Rated, Film Logs, reviews, watchlists, custom lists, Tier lists, Film Clubs, trivia, imports, public sharing, recommendations, social features, and other tools that FilmShuffle offers now or later.
FilmShuffle is initially offered as a beta service. Beta features may be incomplete, contain errors, change without notice, become unavailable, or be reset. We may add, modify, suspend, limit, or discontinue any part of the Service. We will make reasonable efforts to avoid unnecessary loss of user data and to give notice of material changes when practical, but we do not guarantee that beta data, rankings, lists, uploads, settings, or features will always be preserved.
The Service may not be available in every country, language, or location. FilmShuffle is operated from the United States. We may restrict registration, access, features, or paid services where necessary for legal, safety, operational, or business reasons. Nothing in these Terms limits consumer rights that cannot lawfully be waived in your place of residence.
3. Accounts and account security
You must provide accurate information and keep it current. You may not impersonate another person, falsely claim an affiliation, create an account for someone without authorization, or use an account that has been sold, transferred, or obtained improperly.
You are responsible for activity under your account and for protecting your password and sign-in credentials. Notify us promptly at contact@filmshuffle.app if you believe your account has been accessed without permission. We may require reauthentication or other reasonable verification before changing sensitive account information, exporting data, or deleting an account.
You may not sell, license, rent, trade, or transfer your account. FilmShuffle may reject, reclaim, or require changes to usernames, display names, profile images, or other account identifiers that violate these Terms, create confusion, infringe rights, or present safety concerns.
4. Visibility, sharing, and audience controls
Features may offer Public, Friends, or Private visibility. Not every feature will necessarily offer every option. The visibility option shown when you post, save, publish, or share content controls who may access it, subject to moderation, technical limitations, and these Terms.
- Public content may be viewed, copied, linked to, indexed, captured, or shared by anyone, including people without an account.
- Friends content is intended for accepted friends who are not blocked, but recipients may still save or redistribute what they see.
- Private content is intended to be available only to you and authorized service personnel or providers when reasonably necessary to operate, secure, support, or comply with law.
Some features may generate an unlisted or public sharing link. Anyone who obtains such a link may be able to view the shared content until the link is revoked or the underlying content is deleted. Do not use public sharing for information you want to keep confidential.
Blocking limits specified interactions but cannot erase information that another person previously viewed, copied, downloaded, or received. Blocking also may not prevent access by a signed-out person to content that remains public.
FilmShuffle will make reasonable efforts to honor the visibility controls it presents. No online system is perfect, however, and you should not upload highly sensitive information that could cause serious harm if disclosed.
5. User Content
5.1 What User Content includes
“User Content” means anything you submit, upload, import, create, publish, transmit, store, display, or otherwise make available through the Service. It may include reviews, ratings, rankings, lists, comments, profile information, usernames, images, photographs, links, audio, video, imported data, Film Club activity, votes, reactions, AI-assisted material, feedback, and other content made available through features offered now or later.
5.2 You retain ownership
As between you and FilmShuffle, you retain whatever ownership rights you have in your User Content. These Terms do not transfer ownership of your original User Content to FilmShuffle.
5.3 License needed to operate the Service
You grant FilmShuffle a worldwide, nonexclusive, royalty-free license to host, store, cache, reproduce, process, adapt for technical or formatting purposes, transmit, display, distribute, and otherwise use your User Content as reasonably necessary to:
- operate, provide, maintain, secure, troubleshoot, and improve the Service;
- make the content available to the audience you selected;
- generate previews, thumbnails, rankings, recommendations, accessibility formats, links, feeds, backups, and other Service functionality;
- moderate content, investigate reports, enforce policies, prevent abuse, and protect users or the public;
- comply with law, legal process, and valid rights-protection requests; and
- transfer the Service or relevant assets in a merger, acquisition, financing, reorganization, or sale, subject to the Privacy Policy.
This license includes the right to use service providers to perform those functions and to permit other users to view and interact with your User Content according to your visibility settings and Service features. It also includes reasonable technical modifications such as resizing, transcoding, compressing, cropping, formatting, or creating display copies.
We will not use your private User Content, name, or likeness in third-party advertising without separate permission. We may display public User Content within the Service and in previews or links generated by the Service.
The license ends when your User Content is deleted from active systems, except to the extent copies remain temporarily in backups, must be retained for legal, safety, fraud-prevention, moderation, dispute, or compliance purposes, or were independently saved or reposted by another person.
5.4 Your promises about User Content
You represent and warrant that:
- you own your User Content or have all rights and permissions necessary to submit it and grant the license above;
- your User Content and our permitted use of it do not infringe copyright, trademark, privacy, publicity, contractual, or other rights;
- your User Content does not violate law, these Terms, or the Community Guidelines; and
- any disclosure you make about compensation, gifts, access, employment, or other material relationships is truthful and clear.
Do not upload content merely because it is available online. Giving credit does not automatically give you permission to use someone else’s work.
5.5 No duty to publish or preserve
FilmShuffle is not required to publish, host, retain, promote, distribute, or restore User Content. We may remove or restrict content under these Terms, the Community Guidelines, a legal request, or our reasonable judgment.
6. Community conduct and moderation
You must follow the Community Guidelines. Among other things, you may not use FilmShuffle for harassment, threats, hate, exploitation, nonconsensual intimate imagery, child sexual abuse material, doxxing, impersonation, scams, spam, malware, fake engagement, rating manipulation, review bombing, unauthorized automation, infringement, or illegal activity.
FilmShuffle may use automated systems, human review, user reports, or a combination of them to identify or evaluate possible violations. Automated and human systems can make mistakes. Depending on context, severity, history, and risk, we may label content, reduce visibility, remove content, issue warnings, restrict features, remove a person from a Film Club, suspend an account, or terminate an account. We are not required to use those measures in a particular order.
Where a review process is offered, you may request review through Contact/Support. A review request does not suspend the original decision unless FilmShuffle says otherwise and does not guarantee reversal. We may withhold private information, security methods, reporter identities, or investigation details.
FilmShuffle may preserve and disclose information or report conduct when reasonably necessary to protect a person, investigate abuse, comply with legal obligations, or respond to valid legal process. FilmShuffle support is not an emergency service.
7. Authentic reviews, ratings, rankings, and disclosures
Your reviews, ratings, rankings, viewing claims, votes, reactions, and recommendations must reflect genuine activity and opinions. You may not:
- falsely claim that you watched a film or attended an event;
- buy, sell, trade, or condition benefits on positive or negative reviews, ratings, rankings, votes, or reactions;
- coordinate false reports, review bombing, rating manipulation, brigading, or deceptive engagement;
- use bots, scripts, fake accounts, or undisclosed automation to manipulate FilmShuffle; or
- present fabricated or automatically generated material as an authentic personal viewing experience.
If you have a material connection to a film, filmmaker, studio, distributor, exhibitor, sponsor, or related business—including payment, employment, free access, gifts, professional credit, or another benefit—you must clearly disclose it when the connection could affect how another person evaluates your recommendation.
8. Imports and third-party accounts
FilmShuffle may allow you to import data from services such as Letterboxd or IMDb by providing an export file or using another supported method. You authorize FilmShuffle to process the data you select and create corresponding FilmShuffle records. You are responsible for confirming that you have authority to import the data and for reviewing the results.
Imports may be incomplete or inaccurate because of missing identifiers, different rating systems, duplicate records, unsupported fields, or matching errors. FilmShuffle may skip, convert, merge, or flag records according to the import flow. Unless the Service expressly says otherwise, FilmShuffle is not affiliated with or endorsed by the source service.
Do not provide another service’s password to FilmShuffle unless a clearly identified, authorized sign-in flow specifically requests it. Current file-import tools do not require Letterboxd or IMDb passwords.
9. Automated, recommendation, and AI-assisted features
The Service may use algorithms, automated systems, or artificial intelligence to moderate profile information, organize content, calculate rankings, provide recommendations, generate summaries or suggestions, detect abuse, or power other features. These systems may produce incomplete, inaccurate, biased, offensive, or unexpected results.
You remain responsible for what you submit, publish, or rely on. Do not use an automated feature as a substitute for professional, legal, medical, financial, safety, or emergency advice. FilmShuffle may change or discontinue an automated model, formula, weight, category, or output without preserving past results.
If a feature permits you to submit content to a third-party AI provider, FilmShuffle will provide any additional notice reasonably required by law or appropriate to the feature. FilmShuffle does not currently promise that user-facing AI output will be available or error-free.
10. Film information and third-party materials
Film information, posters, images, credits, dates, metadata, links, and other materials may come from third parties, including TMDB, or from users. FilmShuffle does not guarantee that third-party information is complete, current, accurate, available, or free of errors.
“This product uses the TMDB API but is not endorsed or certified by TMDB.” TMDB and other third-party names, marks, and content belong to their respective owners. FilmShuffle’s use of them does not imply sponsorship or endorsement.
The Service may link to third-party sites or services. FilmShuffle does not control and is not responsible for their content, privacy practices, availability, transactions, or security. Your use of a third-party service is governed by that service’s terms and policies.
11. FilmShuffle intellectual property
Except for User Content and third-party materials, the Service—including its software, design, organization, branding, logos, text, graphics, interfaces, ranking systems, and compilations—is owned by FilmShuffle or its licensors and is protected by intellectual-property law.
Subject to these Terms, FilmShuffle grants you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Service for lawful, noncommercial personal use, and for any commercial use that FilmShuffle expressly authorizes in writing.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, scrape, harvest, frame, mirror, or create derivative works from the Service except as law permits or FilmShuffle expressly authorizes. You may not bypass access controls, probe security without prior written authorization, interfere with the Service, or use FilmShuffle data to build a competing database, model, or service.
12. Copyright complaints and repeat infringers
FilmShuffle respects intellectual-property rights. Copyright owners and authorized representatives may submit notices under our Copyright and DMCA Policy. Users may submit counter-notices where available under that policy.
FilmShuffle has adopted a policy of terminating, in appropriate circumstances, users who are repeat infringers. We may also limit access, remove content, or terminate accounts for a single serious infringement or other rights violation.
Copyright notices must be directed to the designated Copyright Agent identified in the Copyright and DMCA Policy. Ordinary community reports do not replace a formal copyright notice.
13. Intimate-image removal requests
A person depicted in an intimate image or video that was published without consent, or an authorized representative, may use the process described in the Intimate Image Removal Policy. That process is available without a FilmShuffle account.
A general community report can alert us to harmful content, but it does not replace a legally required intimate-image removal request when the specialized process applies. Never send or re-upload suspected child sexual abuse material or a nonconsensual intimate image to FilmShuffle merely to make a report. Provide the location or identifying information instead.
14. Premium and other paid services
This section applies only if and when FilmShuffle offers Premium, another subscription, or a paid feature.
14.1 Checkout disclosures and authorization
Before charging you, FilmShuffle will display the price, billing interval, included features, automatic-renewal terms, cancellation method, and any material limitations. By completing checkout, you authorize FilmShuffle and its payment processor to charge the displayed amount, applicable taxes, and recurring renewal charges until you cancel.
Paid consent must be affirmative and separate from merely creating a free account. Prices shown at checkout control over general descriptions elsewhere.
14.2 Automatic renewal
Monthly and annual subscriptions automatically renew for successive periods of the same length unless canceled before the next renewal date. Your account or receipt will identify the applicable billing schedule. FilmShuffle may send renewal notices when required by law or when we choose to do so.
14.3 Cancellation
You may cancel at any time through the online account or billing controls made available for that purpose. Cancellation stops future renewal charges. Unless law or the checkout terms require otherwise, Premium remains active through the end of the already-paid billing period.
FilmShuffle will not require you to use a materially more burdensome cancellation method than the method used to subscribe. Keep your cancellation confirmation.
14.4 Refunds
Except where required by law or expressly stated at checkout, payments are nonrefundable and FilmShuffle does not provide prorated refunds or credits for partially used billing periods, unused features, account inactivity, or a decision to stop using the Service.
14.5 Trials and promotions
FilmShuffle does not offer a free trial unless the checkout page expressly says otherwise. Promotional pricing or limited offers may have separate terms. Unless those terms say otherwise, a promotional subscription renews at the then-current regular price after the promotional period.
14.6 Price changes
FilmShuffle may change future subscription prices. A price change will apply no earlier than your next renewal after any advance notice required by law. You may cancel before the new price takes effect.
14.7 Payment processing, taxes, and failed payments
Payments may be processed by Stripe or another identified payment provider. The processor’s terms and privacy policy also apply. FilmShuffle may receive limited billing information but does not need to receive your complete payment-card number.
You are responsible for applicable taxes unless they are included in the displayed price. If payment fails, FilmShuffle may retry the charge, request an updated payment method, restrict Premium features, or suspend the paid service.
14.8 Account deletion and paid service
Deleting your FilmShuffle account cancels future subscription renewal and may immediately end Premium access. Except where required by law, deleting an account does not create a right to a refund for unused time. The deletion flow will provide a clear warning before completion.
14.9 Changes to paid features
FilmShuffle may change the features included in a paid plan, but will not use that right to avoid providing the core paid service for which you were charged. Where required, we will provide notice or an appropriate remedy for a material adverse change.
15. Communications
FilmShuffle may send transactional or relationship communications relating to authentication, security, account changes, community activity, moderation, support, imports, subscription billing, or changes to the Service or legal terms.
FilmShuffle may send marketing or newsletter emails when you have signed up for them or when otherwise permitted by law. Marketing emails will include an unsubscribe method. Unsubscribing from marketing does not stop necessary transactional or legal communications.
You are responsible for keeping your email address current. Electronic notices are effective when sent to the address associated with your account or posted through the Service, subject to applicable law.
16. Account deletion, suspension, and termination
You may delete your account through the available account controls. Account deletion is intended to be immediate and generally irreversible after final confirmation and reauthentication. You should export any available account data you want to keep before deleting.
Deleting an account generally removes the profile, owned content, and uploaded files from active systems. Some records may be retained or de-identified when reasonably necessary for security, fraud prevention, legal compliance, rights protection, moderation, support, disputes, billing, enforcing these Terms, or normal backup operations. Content or references independently created or saved by other users may remain.
FilmShuffle may suspend, restrict, or terminate your access if you violate these Terms or other policies, create risk, fail to pay for a paid service, use the Service unlawfully, or if continued access is not commercially or operationally feasible. Where appropriate, we may provide notice and an opportunity to request review, but serious conduct may result in immediate action.
Upon termination, your right to use the Service ends. Sections that by their nature should survive—including ownership, licenses needed for retained copies, disclaimers, limitations of liability, indemnity, dispute provisions, and miscellaneous terms—will survive.
17. Feedback
If you send ideas, suggestions, or feedback about FilmShuffle, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate the feedback without restriction or compensation. This does not give FilmShuffle ownership of unrelated User Content.
18. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” FILMSHUFFLE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
FilmShuffle does not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components; that content or data will be preserved; that rankings or recommendations will be accurate; or that defects will be corrected. You use the Service at your own risk.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FILMSHUFFLE LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE; OR DAMAGES ARISING FROM UNAUTHORIZED ACCESS, CONTENT, THIRD-PARTY CONDUCT, SERVICE INTERRUPTION, OR DATA LOSS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF FILMSHUFFLE AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID DIRECTLY TO FILMSHUFFLE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not exclude liability that cannot legally be excluded, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits exclusion. Your jurisdiction may provide additional nonwaivable rights.
20. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless FilmShuffle LLC and its members, managers, officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, and reasonable legal fees arising from your User Content, your unlawful or wrongful use of the Service, your material violation of these Terms, or your infringement of another person’s rights.
FilmShuffle will give you reasonable notice of a covered claim and may control the defense and settlement. You may not settle a claim in a way that admits liability by FilmShuffle or imposes obligations on FilmShuffle without our written consent. This section does not require a consumer to indemnify FilmShuffle for FilmShuffle’s own unlawful conduct and applies only to the extent enforceable under applicable law.
21. Informal dispute resolution
Before filing a lawsuit, you and FilmShuffle agree to make a good-faith effort to resolve the dispute informally for at least 30 days.
A notice to FilmShuffle must include your name, account email if applicable, a description of the dispute, the relief requested, and information reasonably sufficient for us to evaluate the matter. Send it to contact@filmshuffle.app with the subject “Legal Dispute Notice”, or mail it to:

FilmShuffle may send a dispute notice to your account email. Either party may seek urgent injunctive relief without completing the informal process when necessary to prevent immediate harm, misuse, or infringement.
22. Governing law and courts
Except where nonwaivable consumer law requires otherwise, these Terms and disputes arising from them are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
Subject to the informal process above, you and FilmShuffle consent to exclusive jurisdiction and venue in the state courts located in Porter County, Indiana, or the United States District Court for the Northern District of Indiana. Either party may bring an eligible claim in small-claims court.
These Terms do not require mandatory arbitration and do not include a class-action waiver. Nothing in this section deprives a consumer of protections or a forum that applicable law does not allow the consumer to waive.
23. Export controls and sanctions
You may not use, export, or re-export the Service in violation of U.S. export-control, sanctions, or trade laws. You represent that you are not prohibited from receiving the Service under applicable law.
24. Changes to these Terms
FilmShuffle may update these Terms to reflect changes in the Service, law, safety practices, or business operations. We will post the updated Terms and change the effective date. We will provide additional notice or request renewed acceptance when required by law or when we determine that a change is material.
Changes apply prospectively from their effective date. If you do not agree to updated Terms, you must stop using the Service and may delete your account before the updated Terms take effect, subject to any obligations already incurred.
25. Miscellaneous
These Terms and incorporated policies are the entire agreement between you and FilmShuffle regarding the Service, except for additional terms that apply to a particular feature or purchase. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain effective.
FilmShuffle’s failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. FilmShuffle may assign them in connection with a merger, acquisition, financing, reorganization, sale of assets, or operation of the Service. Headings are for convenience only. “Including” means “including without limitation.”
